The Biking Market (“TBM”, “Company”, “The Company”) is committed to maintaining robust privacy protections for its users. Our Privacy Policy (“Privacy Policy”) is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using our Services (TBM services).
For purposes of this Agreement, “TBM services” refers to the Company’s websites, mobile applications, products or services, or brand. The terms “we,” “us,” and “our” refer to the Company. “You”, “your”, “you’re” refers to you, as a user of the Service. By accepting our Privacy Policy and Terms of Use you consent to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.
I. INFORMATION WE COLLECT AND HOW WE USE IT
We may collect and store information about you when you use TBM services. This information includes TBM data usage, personal information, referring/exit pages and URLs, platform types, communications, preferences you select, activity, content (public only), and other information related to transactions.
We may use the information we collect about you to improve our service, personalize your experience, allow you to create and manage your user account, communicate with other users, Website usage analytics, meet fulfillment obligations related to a request for products and/or services, or in any other way listed in this privacy policy.
We may share certain information we collect with our third parties. Please see Section II for how we share information.
a. Submitted Information
When you create an account using a TBM Service, we may collect the information you submit during the account registration process. In addition, we may collect the information you submit from any form in a TBM Service.
This includes, but is not limited to information such as full name, username, phone number, credit card number, billing information, shipping address, email address, city, state, zip code, company name, third party account credentials, personal preferences, and other information you include in your account of form submission.
b. Publicly Available Information
Information you make available via your public profile is intended for public consumption, and we may display/distribute/share this information with third parties and other services.
Users can modify the content that is displayed on their public profile and exclude certain information from being publicly available in their account settings.
c. Site Interactions
Whether you are a registered user or not, whenever you interact with any TBM Service, we automatically collect and record information on our server from your browser. This includes your IP address, cookies, website navigation information, geolocation, and device information.
For site visitors who are not yet registered, we may collect other information for the purposes of certain features. This includes but is not limited to subscribing to our newsletter or periodic communications, sending invitations to others, or sharing site content with others.
d. Account Usage
We may collect information in regards to how you use your account to interact with other users (including their content) and information about the devices you use to access TBM services. This may include searches, viewing users, day and time of account usage, account preferences, account purchases, channels and methods used to enter/exit/refer user pages, referring URL’s, IP addresses, browser types, mobile carriers, mobile devices, phone numbers, geolocation, GPS location, beacon location, and browser language. You may be able to restrict location information depending on the device and/or browser you are using.
Please note that we may receive data from third-party applications, in the event, you accessed a TBM service via the third party. In addition, you may have the option to connect your account to third-party services using a TBM Service. These connections are optional and your permission must be granted for a connection to be established. You reserve the option to disconnect a connection at any time in your account settings.
e. Communications
When you create an account, you are opting to receive messages from TBM and TBM service users. Also, for users who do not create an account, you are opting to receive messages from TBM if you interact with any TBM users or explicitly request to receive communication from TBM.
You cannot opt-out of certain administrative, legal, and transaction messages from TBM, however, you can modify messages you receive from TBM service users by visiting your settings.
We reserve the right to restrict/delete communications amongst users that we consider a violation of our Terms of Use.
f. Transactions
We may collect information regarding transactions you make while using TBM services, such as purchasing certain TBM services, posting listings, or the purposes of processing your transaction and future forms. This information may include first name, business name, address, phone numbers, and credit card information. All submitted credit card information is encrypted using industry-standard technology.
Sellers are obligated to use Transaction information provided to them for the purposes of fulfilling TBM order obligations. This includes but is not limited to using shipping information to ship a good, using purchase information to respond to a direct question a buyer has, reviewing orders for reconciliation of business financials.
Sellers must not use any transaction information for any unauthorized purposes, such as to facilitate a non-TBM transaction or communicate with TBM users in an unauthorized manner.
g. Advertisements
TBM may use your browsing history, purchasing history, defined purchase preferences, or inquiry history to make suggestions to you or show you advertisements. All collected usage information is collected in an aggregated and non-identifiable manner.
TBM may provide usage information to advertising partners for the sole purpose of understanding how users use our website. Unless you agree to the disclosure, we do not disclose your personal information to a third party for direct marketing purposes.
From time to time, you may receive TBM promotional materials from our Sellers. You may also receive promotions or informative materials from TBM.
Please note that our privacy policy does not cover our advertising partners utilizing their own cookies in relation to an advertisement you engage in or deliver web beacons through our website for their advertising purposes.
h. Other Information we may collect
We collect user information using cookies, tags, local shared objects, and similar technology. Our third parties and others we partner with may do the same from time to time. Cookies may have unique identifiers and may be sent to a user’s browser or mobile device in emails and/or by visiting TBM service pages (website).
For example, the Company may use cookies to collect the following information: searches, IP addresses, advertising data, and date and time of account usage. The Company may use both persistent and session cookies; persistent cookies remain on your computer after you close your session and until you delete them, while session cookies expire when you close your browser.
Our tracking of cookies may be used for the following purposes: authentication, security, preferences, compliance, analytics, internal processes, notifications, and advertising.
You may be able to restrict some cookies in your settings, but it may affect the functionality of the TBM services.
II. HOW WE SHARE INFORMATION
Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent, or otherwise share for marketing purposes your Personal Information with third parties without your consent. We do share your personal information with the following, who we consider privy partners:
- affiliated businesses we contract with to provide services to TBM Users
- agents who perform services on our behalf
- vendors who are performing services for the Company, such as the servers for our email communications who are provided access to a user’s email address for purposes of sending emails from us.
All privy partners use your Personal Information only at our direction and in accordance with our Privacy Policy.
In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred. You acknowledge and consent that such transfers may occur and are permitted by this Privacy Policy and that any acquirer of our assets may continue to process your Personal Information as set forth in this Privacy Policy.
We may share information with legal authorities and/or law enforcement in the event of a court order, warrant, legal proceeding, subpoena, law or statute, or other similar legal requirements.
If our information practices change at any time in the future, we will post the policy changes to the TBM services so that you may opt-out of the new information practices. We suggest that you check the TBM services periodically if you are concerned about how your information is used.
III. HOW WE PROTECT INFORMATION
We implement security measures designed to protect your information from unauthorized access. In addition, we implement security measures to anonymize your personal information so that you cannot be identified.
Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. Passwords for third-party connected sites are independent of TBM service passwords.
We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls, and secure layer technology. However, these measures do not guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of such firewalls and secure server software. By using TBM services, you acknowledge that you understand and agree to assume these risks.
V. LINKS TO OTHER WEBSITES
As part of the Services, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain. This Privacy Policy applies solely to information collected by us through the TBM services. Therefore, this Privacy Policy does not apply to your use of a third-party website accessed by selecting a link on our TBM services or via our Services. To the extent that you access or use the TBM services through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.
VI. MY OPTIONS
You can change your communication and privacy settings in your account. Please note that opting out of certain settings may cause performance issues with your experience.
You can add, update, or delete your account information in your settings. Please note that when you update or delete your account information, unrevised versions may remain in TBM records. TBM may use, as an aggregate and not in an identifiable manner, data derived from or incorporating your personal information even if you update or delete it. This includes, but is not limited to, the use of your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
TBM does not honor do-not-track signals from Internet browsers or other consumer choice mechanisms regarding the collection of behavioral tracking data.
You may inform us of any changes or requests with regards to your personal data, and in accordance with our duty under local data protection law, we may update or delete your personal data accordingly.
If you no longer want to use a TBM service, you can close your account in your account settings. Please note that we will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
VII. MODIFICATIONS TO OUR PRIVACY POLICY
The Company reserves the right to change this policy and our Terms of Use at any time. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on the TBM services. Significant changes will go into effect 30 days following such notification. Non-material changes or clarifications will take effect immediately. You should periodically check the TBM services and this privacy page for updates.
